In a groundbreaking and far-reaching decision, the Supreme Court of India has declared that students from open schools recognized by the Central Board of Secondary Education (CBSE) and State Boards are now eligible to participate in the National Eligibility cum Entrance Test (NEET). This landmark ruling, addressing long-standing restrictions, marks a significant revision of eligibility criteria, expanding opportunities for those aspiring to pursue a career in medicine.
The Supreme Court underlined that all open schools recognized by CBSE and State Education Boards will now be officially recognized by the National Medical Council (NMC) for NEET purposes. Consequently, individuals who have completed their 10+2 education from open schools will now have the eligibility to take the examination. It’s noteworthy that a prior provision in Regulation 4(2)(a) of the Medical Council of India Regulations on Graduate Medical Education, 1997, had previously prohibited such candidates from participating in these exams.
In 2018, the Delhi High Court invalidated this provision, declaring it unconstitutional. The High Court determined that the assumption made by the medical council, implying the inferiority of students who do not attend regular schools due to financial or social reasons, violated both Article 14 and the right to the opportunity to acquire a professional degree.
In response to these events, the Supreme Court concluded the appeal, recognizing the acceptance of open schools by CBSE and State Education Boards for NEET purposes.

The revised eligibility criteria for NEET 2024 remove the upper age limit for candidates and introduce new reservation criteria for various categories, including OBC, EWS, SC, ST, and PwD, under the 15% All India Quota seats.

Eligibility Criteria for NEET Open School Students
Currently, open-school students, including those affiliated with NIOS, are eligible to participate in the NEET exam. Furthermore, candidates with an additional biology subject are also allowed to take the exam. To be eligible for NEET 2024, aspirants must fulfill the following criteria:
- Age Criteria: All categories of students must be a minimum of 17 years old as of December 31 in the year of admission.
- There is no maximum/upper age limit for candidates taking the NEET exam, as determined during the fourth NMC meeting on October 21, 2021.
- Aggregate Marks: For the General Category – 50% (45% for Physically Handicapped, PH); for OBC/SC/ST – 40% (40% for PH).
- Number of Subjects: Physics, Chemistry, and Biology are considered (Mathematics is not included, Mathematics students will have to clear Biology as additional subject).
- There is no restriction on the number of attempts for the NEET exam.
- Year of Passing: Eligible candidates include those scheduled to take their board exams in 2024 and individuals who have completed their Class 12 exams but are opting for an improvement exam.
